Terms of Service

These terms apply to all photography and video services booked with Kessy Janabi, trading as Kessy.mp4, 4032 Debrecen, Hungary (“I”, “me”). Every booking also has its own contract, signed in the client area. If anything differs, your signed contract takes priority.

1. Services and prices

• I provide photography for the package you book. Your package, shoot date, location and price are stated on the Signatures page of your contract.
• Every shoot is quoted individually, tailored to what you need. Your price, in Hungarian forints (HUF), is agreed with you in writing before you book.
• Anything that is not part of your package is only added if we both agree to it in writing. A message or email is fine.

2. Booking and payment

• A 50% deposit secures your date. Your date is only reserved once I have received it. The deposit is paid when you book.
• The deposit is non-refundable, except where the cancellation or liability sections below say otherwise.
• You can pay in cash or by Revolut to @kcjanabi.
• Portraits, graduations and photo + video shoots: the remaining 50% is due on the day of the shoot. Your edited files are delivered once everything has been paid.
• Events: the remaining 50% is due within 7 days of receiving your gallery link.
• Your payments and any balance still due are always visible in your client area.
• Extra time, travel or add-ons we agree on are added to your balance. For shoots outside Debrecen, travel costs are agreed with you before the booking.

3. Rescheduling and cancellation

• If you cancel 14 days or more before the shoot: the deposit is non-refundable, but you can move it once to a new date within 6 months, if I am available.
• If you cancel less than 14 days before the shoot (late cancellation): I keep the deposit and it cannot be moved to a new date.
• Rescheduling: with at least 14 days’ notice, you can move your shoot once at no extra cost, if I am available. If none of my available dates works for you, it counts as a cancellation.
• Bad weather: if the weather makes an outdoor shoot unsafe or impossible, we move it to a new date at no extra cost.
• Illness: if you are ill, let me know as soon as possible. With proper evidence (such as a doctor’s note), we move the shoot to a new date at no extra cost.
• If I have to cancel (for example because of illness or an emergency), you choose: a full refund of everything you have paid, or a new date. Where possible, I will also recommend another photographer.

4. On the day

• Please arrive on time. Late arrival comes out of the booked time: the shoot still ends at the planned time and the price stays the same.
• Extra time is possible if I am available, at a rate agreed with you on the day.
• If you choose a private location, you arrange any permission and pay any fees it needs.
• Events: please send me the schedule and any must-have shots at least 7 days before, and name a contact person for the day. For events longer than 5 hours, I take a 30-minute break and need a meal (or a meal allowance agreed in advance).
• Under 18: I do not work directly with anyone under 18. Their parent or guardian signs the contract and must be present for the whole shoot.

5. Delivery

• Your edited photos are delivered within 10 business days after the shoot, through an online gallery link in your client area.
• Each link stays available for 30 days and then expires. Please download your files within that time. I keep a backup for 3 months after delivery but cannot store files after that.
• Photos are edited in Lightroom in my style. I choose which images are worth editing; the number of edited images is part of your package.
• No RAW or unedited files are provided.
• One round of small adjustments (for example a colour tweak or minor retouch), requested within 7 days of delivery, is included.
• In your client area you choose “social media”, “print quality”, or both, and I export the photos accordingly.

6. Copyright and usage

• I keep the copyright to all photos and videos I create for you (Hungarian Act LXXVI of 1999 on Copyright).
• You get a personal-use licence: you can keep, print and share them with family and friends, and post them on your personal social media. A credit or tag to @kessy.mp4 is appreciated.
• Without my written permission, you may not use them commercially (advertising, brand or product promotion, paid campaigns, selling them), or apply edits or filters that change my edit. Commercial use can be agreed separately for an extra fee.
• I may use the photos in my portfolio, on my website and on my social media, unless you opt out in writing (message or email) at least 14 days before the shoot. Private-shoot contracts are the exception: I never share those photos without your written permission.
• You can ask me at any time to remove a specific photo or video from my website or social media, and I will do so within 14 days.

7. Events, venues and guests

• You are responsible for getting permission for me to photograph at the venue, and for telling me about any venue rules in advance.
• You are responsible for informing your guests that photos are being taken. If a guest asks not to be photographed, or asks me to remove a photo of them, I will respect that.
• If other people appear in your portraits and you would like them posted, they should sign my model release.

8. Liability

• My total liability is limited to the amount you have paid me.
• I am not liable for things outside my control, such as force majeure (severe weather, natural disasters, travel disruption, venue closure, illness or emergency), venue restrictions, or equipment failure despite the backup equipment I bring. If something like this stops me from working on the day, I will try to reschedule or find a replacement; if neither is possible, you get a full refund of what you have paid.
• In the rare case that files are lost or damaged before delivery, you get a full refund of everything you have paid.
• I am not liable for loss, damage or injury caused by you or your guests.

9. Consumers’ right of withdrawal

If you book as a private consumer, note that under Hungarian Government Decree 45/2014 (II.26.) the 14-day right of withdrawal does not apply to leisure-related services booked for a specific date or period.

10. Signing online and personal data

• Signing electronically in the Kessy.mp4 client area, by typing your full name and drawing your signature, is a valid and binding simple electronic signature under EU Regulation 910/2014 (eIDAS). Both of us receive a copy of the signed PDF.
• I handle your personal data as described in my privacy policy.

11. Governing law

These terms and your contract are governed by Hungarian law. We will first try to solve any disagreement by talking. If that does not work, disputes go to the courts of Debrecen, without prejudice to any mandatory consumer-protection rights in your country of residence.
